Terms & Conditions
We want your island getaway to be as smooth as the waters around Pulau Kapas. To make sure everyone’s on the same page, here’s what you’re agreeing to when you book with us — written in plain language, but still the real deal legally. By reserving with Kapas Heritage Resort, you’re confirming this on behalf of yourself and everyone in your booking party.
Making a Reservation
Bookings depend on availability, so nothing is guaranteed until it’s confirmed. Your reservation only becomes official once we’ve received full payment and sent you a Booking Confirmation with a Reservation Number — keep that number handy. Please double-check your details before you hit confirm; it’s much easier to fix things before booking than after.
Payment
We require full payment upfront to lock in your room or package. You can pay through our online gateway, bank transfer, or another approved method. All prices are shown in Malaysian Ringgit (MYR) unless we say otherwise. Heads up — government taxes, tourism tax, marine park conservation fees, jetty fees, or other official charges may apply on top of your package price, and these are the guest’s responsibility.
What’s Included in Your Package
Depending on which package you choose, your stay may include:
- Accommodation
- Return boat transfers
- Meals
- Snorkeling
- Diving packages
- Island activities
Only what’s specifically listed in your confirmed package is included. Anything extra — additional activities, equipment rental, drinks, transport, or personal expenses — will be charged separately unless we’ve said otherwise.
Getting to the Island
Boats run on a set schedule and depend on the weather. Please arrive at the jetty ahead of your departure time — we’re not able to hold the boat or offer refunds for missed departures due to late arrival. If you’d like a private transfer, we can look into arranging one for an extra cost, subject to availability.

Want to arrive earlier or leave later? Just ask — we’ll do our best to accommodate, subject to room availability, though extra charges may apply.
Identification
Every guest needs to bring a valid government-issued photo ID or passport at check-in, with the name matching the reservation. This just helps us keep things safe and accurate for everyone.
Changing or Cancelling Your Booking
Plans change, so here’s where we stand:
More than 30 days before arrival:
Free amendments, subject to availability.
15–30 days before arrival:
Amendments may still be possible, but an admin fee may apply.
Less than 14 days before arrival:
Unfortunately, no refunds at this point.
No-shows:
If you don’t arrive on your scheduled date without letting us know, the full booking value is forfeited.
All cancellation or amendment requests need to be sent to us in writing by email — this keeps things clear and on record for both sides.
When Things Are Out of Our Hands
Sometimes nature or circumstances beyond anyone’s control get in the way — severe weather, rough seas, natural disasters, government restrictions, pandemics, ferry disruptions, or other acts of God. In these cases, we’re not able to be held liable. Where we can, we’ll try to offer an alternative date or resort credit at management’s discretion.
Diving, Snorkeling & Water Activities
Adventure is part of the island experience, but it does come with some responsibility on your end. By joining snorkeling, diving, kayaking, or other water activities, you’re confirming that:
- You’re physically fit to take part
- You’ll follow the safety instructions from our certified instructors and staff
- You’ll let us know about any medical conditions that might affect your participation
For everyone’s safety, we reserve the right to hold back a guest’s participation if there’s a health or safety concern. If an activity is cancelled due to bad weather or sea conditions, we’re unable to offer a refund, but we’ll try to reschedule or suggest an alternative where possible.
House Rules
A few simple things to keep the island experience pleasant for everyone:
- Smoking is only allowed in designated areas
- Pets aren’t permitted unless we’ve approved it in writing beforehand
- Please be considerate of other guests and resort property
- We reserve the right to ask a guest to leave, without refund, if their behavior is abusive, dangerous, illegal, or disruptive to others
Damage to Resort Property
If you or someone in your party accidentally damages resort property, or leaves something needing extra cleaning, we may need to charge for repair, replacement, or cleaning costs.
Your Belongings
Please keep an eye on your personal items throughout your stay. We’re not able to take responsibility for lost, stolen, or damaged belongings unless it can be shown that the resort was at fault.
Safety on the Island
Island life comes with outdoor and marine adventures, and with that comes some inherent risk. By joining in activities like swimming, snorkeling, diving, boat transfers, wildlife encounters, or other outdoor recreation, you’re acknowledging those risks. We’re not liable for injury, illness, accident, or death arising from these activities, except where it’s proven to be caused directly by our negligence.
Traveling with Children
Kids are always welcome — just please keep them supervised at all times. Parents and guardians are responsible for their children’s safety and behavior throughout the stay.
Special Requests
Got a room preference, dietary need, anniversary surprise, or accessibility requirement? Let us know and we’ll do our best — though we can’t guarantee every request, as it depends on availability.
Photos & Videos
From time to time, we may take photos or videos around the resort for promotional use. If you’d rather not appear in any of these, just let our Front Office team know when you check in.
Your Privacy
Any personal information you share with us during booking or your stay is used only for managing your reservation, providing guest services, meeting legal requirements, and internal operations. We handle your information in line with Malaysian privacy laws.
Governing Law
These Terms & Conditions are governed by the laws of Malaysia. Any disputes relating to our website, booking platform, or your stay will fall under the exclusive jurisdiction of the Malaysian courts.
Updates to These Terms
We may update these Terms & Conditions from time to time without prior notice. The most current version, published on our official website, will always be the one that applies.
